1. Applicability
1.1 These general terms and conditions apply to all cruises, packages and agreements between Borrelboot Nextlevel (the “Hire Provider”) and the person hiring the boat (the “Customer”).
1.2 By submitting the online enquiry form, confirming a booking date and/or making payment, the Customer agrees to these terms and conditions.
2. Payment and Booking
2.1 A booking is confirmed only once the Customer has paid the full hire fee through the payment request (Tikkie).
2.2 If payment is not received by the deadline stated in the payment request, the Hire Provider may release the held date and time slot for other customers.
3. Bad Weather Guarantee and Cancellation by the Hire Provider
3.1 Safety comes first. In the event of an official weather warning, such as a yellow, orange or red warning for storms or thunderstorms, or prolonged heavy rain, the skipper will decide whether the cruise can proceed safely.
3.2 If the Hire Provider has to cancel the cruise because of weather conditions or an unforeseen technical fault with the boat, the Customer is entitled to one of the following:
- The cruise will be rescheduled free of charge to another available date within the current boating season.
- If rescheduling is not possible, the Customer will receive a full refund of any hire fee already paid.
3.3 The Hire Provider is not liable for any consequential loss incurred by the Customer as a result of a cancellation, such as catering costs or items purchased specifically for the cruise.
4. Cancellation by the Customer
4.1 If the Customer wishes to cancel the booking, the following rules apply:
- More than 7 days before the cruise: The Customer may reschedule or cancel the cruise free of charge and receive a full refund.
- Between 7 days and 48 hours before the cruise: The Customer may reschedule the cruise by mutual agreement. In the event of full cancellation, 50% of the hire fee will be retained.
- Within 48 hours before the cruise: No refund will be issued if the booking is cancelled or the group fails to attend.
5. Behaviour, Alcohol and Safety on Board
5.1 The skipper’s instructions must be followed strictly and immediately at all times. The skipper has ultimate responsibility for the safety of everyone on board.
5.2 Guests may bring their own snacks and drinks, including alcoholic drinks, provided that alcohol is consumed responsibly.
5.3 If, before or during the cruise, one or more guests behave inappropriately, are excessively intoxicated or endanger safety, the skipper may refuse them access to the boat or end the cruise immediately. In either case, the hire fee will not be refunded.
5.4 The use or possession of illegal drugs on board is strictly prohibited.
6. Maximum Group Size and Minimum Age
6.1 No more than eight guests, excluding the skipper, are legally permitted on board. No additional guests will be allowed under any circumstances.
6.2 The lead booker (the Customer) must be at least 18 years old and will remain the skipper’s designated point of contact throughout the cruise.
7. Damage and Liability
7.1 The Customer is liable for any damage caused by guests to the boat, its equipment (such as the sound system or cushions) or the skipper’s property.
7.2 Borrelboot Nextlevel accepts no liability for guests’ personal belongings that are lost, stolen or damaged, such as phones, clothing or sunglasses.
7.3 Guests board the boat and take part in the cruise entirely at their own risk.
